Hosted Affiliate Network Software Terms

These standard terms describe the hosted service. A signed proposal or order form may add project-specific requirements, pricing, and service levels. If they conflict, the signed order form controls for that project.

1. Hosted license

Recruit4Cash grants the client a limited, non-exclusive, non-transferable right to use one configured instance of the Affiliate Network in a Box platform during the paid service term. The service is hosted and operated by Recruit4Cash. Source code, development credentials, and resale or sublicensing rights are not included.

2. Client ownership

The client retains ownership of its domain, trademarks, uploaded brand assets, affiliate relationships, and business data. Recruit4Cash retains ownership of the platform, shared components, improvements, deployment methods, and pre-existing intellectual property. The client may request a reasonable export of its business data when the account is current.

3. Setup and monthly service

The standard package is a $3,500 nonrefundable setup and hosted-license fee plus $100 per month after launch. A signed proposal may change these amounts. Setup begins after payment and receipt of required domain, branding, offer, payout, legal, and integration information. Third-party services, provider fees, traffic, content, custom development, and unusual support are separate unless expressly included.

4. Term and cancellation

Monthly hosting continues until either party gives at least 30 days written notice. Fees already earned, setup fees, and completed custom work are nonrefundable. Before service ends, a client with a current account may request a standard data export. The software and source code are not transferred at termination.

5. Isolated environments and security

Each client network is intended to use separate application releases, database credentials, writable storage, and administrative access. Recruit4Cash applies reasonable operational safeguards, backups, maintenance, and security updates. No internet service can be guaranteed completely uninterrupted or immune from attack. The client must protect its credentials, use appropriate access controls, and promptly report suspected compromise.

6. Client responsibilities

The client is responsible for its offers, commission promises, affiliate approvals, traffic rules, advertiser and affiliate agreements, payment obligations, tax reporting, age restrictions, marketing claims, privacy notices, consent practices, email and SMS compliance, content rights, and all laws applicable to its business and markets. Platform tools do not constitute legal, tax, or compliance advice.

7. Prohibited use

The service may not be used for fraud, malware, credential theft, deceptive earnings claims, unlawful content, non-consensual content, exploitation, sanctions evasion, spam, unauthorized data collection, infringement, or activity that threatens the platform, providers, users, or network reputation. Recruit4Cash may suspend access when reasonably necessary to contain abuse, security incidents, unpaid balances, or legal risk.

8. Tracking and financial records

Tracking and reporting depend on correct links, browser behavior, third-party postbacks, provider data, time zones, network availability, and client configuration. Reports should be reconciled with authoritative advertiser and payment records. The client remains responsible for approving payouts and resolving discrepancies with its affiliates and providers.

9. Availability, support, and changes

Recruit4Cash will use commercially reasonable efforts to keep the service available, maintain backups, and correct reproducible platform defects. Planned maintenance, provider failures, force majeure, abusive traffic, and third-party outages may affect availability. Features may be improved or replaced while preserving materially similar core functionality. Custom work requires written scope and pricing.

10. Confidentiality and data processing

Each party will use reasonable care to protect the other party's nonpublic business, technical, and account information and use it only to perform the relationship. The client authorizes Recruit4Cash and necessary hosting, email, analytics, security, and infrastructure providers to process data to operate and protect the service.

11. Warranties and liability

Except for express commitments in a signed order form, the service is provided as available without implied warranties to the maximum extent allowed by law. Recruit4Cash does not guarantee earnings, traffic, conversions, advertiser performance, or legal compliance. To the maximum extent allowed by law, neither party is liable for indirect, special, punitive, or consequential damages. Recruit4Cash's aggregate liability arising from the service will not exceed fees paid by the client for the affected service during the six months before the event giving rise to the claim.

12. Indemnity

The client will defend and indemnify Recruit4Cash from third-party claims arising from the client's offers, content, affiliate conduct, marketing, payouts, unlawful use, or breach of these terms. Recruit4Cash will promptly notify the client and reasonably cooperate in the defense.

13. General terms

The signed proposal and these terms form the agreement. Neither party may assign the agreement without consent, except in connection with a merger or sale of substantially all relevant assets. California law governs, without regard to conflicts rules. Invalid provisions will be narrowed while the remainder stays effective. Notices must be sent to the business contacts listed in the order form.
